Building product undertakings
The Commission regulates building products to ensure—
- the safety of consumers and the public generally; and
- persons involved in the production, supply or installation of building products are held responsible for the safety of the products and their use.
People in the chain of responsibility for a building product are required to comply with various duties outlined in part 6AA of the Queensland Building and Construction Act 1991. The Commission investigates alleged non-conforming building products and whether people in the chain of responsibility have, or are alleged to have, contravened a duty.
A person may, in connection with a matter relating to a contravention or alleged contravention of part 6AA, give to the Commission a building product undertaking. A building product undertaking sets out how a person will remedy a contravention or alleged contravention without it constituting an admission of guilt. If the Commission accepts a building product undertaking it is binding on the person who gives it and enforceable.
In accordance with sections 74AP and 74AT of the Queensland Building and Construction Act 1991, the Commission is required to publish on its website—
- notice of a decision to accept a building product undertaking and the reasons for the decision; and
- notice of the withdrawal or variation of a building product undertaking.
